The presentation will deal with the concept of economic unit in European competition law which enables enforcers to impose fines on parent companies even though the infringement originated in a subsidiary.
As the European Court of Justice has just confirmed, this concept also applies in private actions for damages (Case C-724/17).
The presentation will focus on this decision, its impact on the Cartel Damages Directive (2014/104/EU) and Member States’ laws, and will also raise doctrinal questions.
